1. Introduction
DiningMate (ABN: 18 862 175 106) ("we", "us", or "our") operates the DiningMate platform, including the website at diningmate.com.au and related services (collectively, the "Platform").
We are committed to protecting your personal information and handling it in a responsible, transparent manner consistent with the Privacy Act 1988 (Cth) ("Privacy Act") and the Australian Privacy Principles ("APPs") contained in Schedule 1 of that Act.
This Privacy Policy explains how we collect, use, disclose, store, and protect your personal information, and your rights in relation to that information. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy. If you do not agree, please do not use the Platform.
2. What Personal Information We Collect
"Personal information" means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not true, and whether or not recorded in a material form.

Full payment card details are processed and stored by our third-party payment processor. We receive only a tokenised representation of your payment method.
2.4 Booking and Usage Information
Restaurant booking history and preferences
Search queries and filters used on the Platform
Communication records between you and us (e.g., support emails)

IP address and device identifiers
Browser type and version
Operating system
Pages visited, time spent on pages, and referring URLs

2.6 Sensitive Information
We do not intentionally collect sensitive information (as defined under the Privacy Act, including health information, racial or ethnic origin, or financial information beyond that needed for billing). Please do not submit sensitive information through the Platform.
3. How We Collect Personal Information
We collect personal information directly from you when you create or update an account, subscribe to a paid plan, make or manage a restaurant booking, contact us for support, or subscribe to marketing communications.
We collect information automatically when you use the Platform, through cookies, web beacons, analytics tools, and similar technologies (see Section 9).
We may collect information from third parties, including our payment processor (transaction confirmation and limited billing details) and analytics providers (aggregated or de-identified usage data). We will only collect personal information from third parties where we are satisfied those third parties have the appropriate authority to disclose that information to us.
4. Why We Collect and Use Your Personal Information
4.1 Primary Purposes
To create and manage your account;
To facilitate restaurant reservations on your behalf;
To process your subscription and payment transactions;
To send you booking confirmations, reminders, and updates;
To provide customer support and respond to your enquiries; and
To send you transactional and administrative communications.
4.2 Secondary Purposes
With your consent (where required), or where otherwise permitted by law:
To send you marketing communications about DiningMate products and promotions (you may opt out at any time — see Section 10);
To conduct research and analytics to improve the Platform;
To personalise your experience and recommendations;
To monitor and improve the security and performance of the Platform; and
To comply with our legal obligations.
We will not use your personal information for a secondary purpose that is unrelated to the primary purpose of collection without your consent, unless required or authorised by law.
5. Disclosure of Personal Information
5.1 Service Providers
Trusted third-party service providers who assist us in operating the Platform, including payment processors (e.g., Stripe) to process subscription payments securely; cloud hosting providers to store and process data on our behalf; email and communication providers to send transactional and marketing emails; analytics providers (e.g., Google Analytics) to understand how users interact with the Platform; and customer support tools to manage support communications. We require all service providers to handle your personal information in a manner consistent with applicable privacy laws and our instructions.
5.2 Restaurants
When you make a booking through the Platform, we share the personal information necessary to confirm and fulfil that booking (such as your name, phone number, and email address) with the relevant Restaurant. Restaurants are required to use that information solely for the purpose of managing your reservation.
5.3 Legal and Regulatory Requirements
We may disclose your personal information if required to do so by law, court order, or governmental authority, or where we reasonably believe disclosure is necessary to comply with applicable laws, protect the rights, property, or safety of DiningMate, our users, or the public, or investigate and take action against suspected fraud or illegal activity.
5.4 Business Transfers
If we are involved in a merger, acquisition, sale of assets, or other business transaction, your personal information may be transferred to the relevant third party as part of that transaction. We will notify you via email or a notice on the Platform before your personal information is transferred and becomes subject to a different privacy policy.
5.5 With Your Consent
We may disclose your personal information to other parties with your explicit consent. We will not sell, rent, or trade your personal information to third parties for their own marketing purposes.
6. Overseas Disclosure of Personal Information
Some of our service providers are located outside Australia, including in the United States. As a result, your personal information may be transferred to, stored, or processed in countries outside Australia. Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure that the overseas recipient does not breach the APPs, consistent with APP 8.
Overseas recipients may include:
Stripe, Inc. (United States) – payment processing
Amazon Web Services, Inc. (United States) – cloud infrastructure
Google LLC (United States) – analytics and email services
By using the Platform, you acknowledge that your information may be transferred to and processed in countries outside Australia, which may have different privacy laws to Australia.
7. Storage and Security of Personal Information
We take reasonable steps to protect the personal information we hold from misuse, interference, loss, unauthorised access, modification, or disclosure. Our security measures include encryption of data in transit (using TLS/HTTPS), encryption of data at rest, access controls and authentication requirements for staff, regular security reviews and vulnerability assessments, and payment card data handling delegated entirely to PCI DSS-compliant processors.
However, no method of transmission over the internet or method of electronic storage is completely secure. If you suspect your account has been compromised, please contact us immediately at support@diningmate.com.au.
7.1 Retention
We retain your personal information for as long as necessary to fulfil the purposes for which it was collected. When personal information is no longer needed, we will take reasonable steps to destroy or de-identify it. Specifically:
Account information is retained for the duration of your account and for a period of 7 years after account closure, to meet our legal and tax obligations;
Booking records are retained for a period of 7 years; and
Payment transaction records are retained for 7 years as required by tax law.
8. Payment Information
We use Stripe to handle all payment transactions. We do not store your full credit card number, card verification code (CVV), or other sensitive card data on our servers. Only a tokenised reference and the last four digits of your payment method are retained by us. For information on how Stripe handles your payment information, please refer to Stripe's Privacy Policy.
9. Cookies and Tracking Technologies
9.1 What Are Cookies
Cookies are small text files placed on your device when you visit a website. We and our third-party service providers use cookies and similar tracking technologies (such as web beacons and pixels) to operate and improve the Platform.
9.2 Types of Cookies We Use
Essential cookies: Necessary for the Platform to function correctly (e.g., session management, authentication). These cannot be disabled.
Analytics cookies: Help us understand how users interact with the Platform (e.g., Google Analytics). This data is aggregated and used to improve the Platform.
Functional cookies: Remember your preferences to personalise your experience.
Marketing cookies: Used to deliver relevant advertising and measure campaign effectiveness (where applicable).
9.3 Your Choices
You can manage or disable non-essential cookies through your browser settings. Please note that disabling certain cookies may affect the functionality of the Platform. You can also opt out of Google Analytics data collection by installing the Google Analytics Opt-out Browser Add-on.
10. Marketing Communications
We may send you marketing emails, push notifications, or other communications about DiningMate products, features, promotions, and partner restaurants.
Opt-in: Where required by the Spam Act 2003 (Cth), we will obtain your consent before sending you commercial electronic messages.
Opt-out: You can unsubscribe from marketing communications at any time by clicking the "unsubscribe" link in any marketing email, updating your communication preferences in your account settings, or contacting us at support@diningmate.com.au.
Please note that even if you opt out of marketing communications, we will continue to send you transactional and administrative messages related to your account and bookings.
11. Access to and Correction of Your Personal Information
11.1 Access (APP 12)
You have the right to request access to the personal information we hold about you. To make an access request, please contact us at support@diningmate.com.au. We will respond within a reasonable time (generally within 30 days). We may charge a reasonable fee to cover the cost of processing your request and will inform you of any applicable fee before proceeding. If we decline your request, we will provide written reasons.
11.2 Correction (APP 13)
If you believe that the personal information we hold about you is inaccurate, out of date, incomplete, irrelevant, or misleading, you may request that we correct it by contacting us at support@diningmate.com.au. We will respond and, where appropriate, correct the information within 30 days. You can also update many of your account details directly through your account settings on the Platform.
12. Children's Privacy
The Platform is not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If you are a parent or guardian and believe that your child has provided us with personal information without your consent, please contact us at support@diningmate.com.au and we will take steps to delete that information promptly.
13. Privacy Complaints
If you believe we have handled your personal information in a manner that does not comply with the Privacy Act or this Privacy Policy, you may make a complaint by contacting our Privacy Officer:

14. Links to Third-Party Websites
Our Platform may contain links to third-party websites. This Privacy Policy does not apply to those websites, and we are not responsible for the privacy practices of any third-party website. We encourage you to review the privacy policies of any third-party websites you visit.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to our practices or applicable law. We will notify you of material changes by sending an email to the address associated with your account and/or posting a notice on the Platform. The updated Privacy Policy will take effect from the date it is posted. Your continued use of the Platform after that date constitutes your acceptance of the updated Privacy Policy.
